Terms of Service

1. Who these terms are with

Cucumber is operated by Swell & Stack Co. LLC, doing business as Swell & Stack Co., a Wyoming limited liability company ("we," "us," "Cucumber"), 30 N Gould St, Ste R, Sheridan, WY 82801, USA. By creating an account or subscribing, you (the business, "you") agree to these terms.

2. What Cucumber is

Cucumber is a client-retention platform for spas and salons: it sends automated follow-up and win-back text messages to your clients, integrates with booking systems (such as Mindbody), and helps draft message copy. We may improve or change features over time.

3. Subscription & billing

Cucumber is a monthly subscription billed through Stripe. Current plans are Starter ($79/month) and Pro ($119/month). Your plan renews automatically each month and the card on file is charged until you cancel. There are no long-term contracts.

4. Cancellation & refunds

You can cancel anytime from your account or by emailing [email protected]. Cancellation stops future renewals; your service continues through the end of the current paid month. Monthly fees already paid are generally non-refundable and there are no partial-month refunds. If a billing error or material service failure occurs, email us within 14 days and we'll make it right, which may include a credit or refund. Nothing here limits any refund right you have under applicable law.

5. Your responsibilities & SMS compliance

You are responsible for consent. You must have the legal right and proper consent to text every client you add, and you must comply with all applicable messaging and marketing laws (such as the U.S. TCPA, CAN-SPAM, and local equivalents). Cucumber includes opt-out handling, but you are responsible for how, when, and to whom you send.

You're also responsible for the accuracy of the content and contact lists you provide and for keeping your login credentials secure.

6. AI disclaimer

Cucumber can use AI to suggest message copy. Suggestions are generated automatically and may be imperfect — you are responsible for reviewing and approving any message before it is sent. AI suggestions are not professional advice.

7. Acceptable use

Don't use Cucumber to send spam, unlawful, harassing, or deceptive messages, to contact people without consent, or to disrupt or reverse-engineer the service. We may suspend accounts that do.

8. Availability

We work to keep Cucumber reliable but don't guarantee uninterrupted service. Third-party outages (Twilio, Stripe, Mindbody, hosting, the AI provider), maintenance, or events outside our control may cause downtime.

9. Intellectual property

We own the Cucumber software and platform. You own your business content, your client lists, and your message history. You may use Cucumber for your business for as long as you're subscribed.

10. Limitation of liability

To the fullest extent permitted by law, Cucumber is provided "as is," and our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost business, or claims arising from messages you chose to send.

11. Governing law

These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles, and disputes will be handled in the courts located in Wyoming, unless applicable consumer-protection law requires otherwise.

12. Changes

We may update these terms; the current version always lives here with its effective date. Continuing to use Cucumber after a change means you accept the updated terms.
